The Bentley that Wellington polo mogul John Goodman drove into the Hyundai of a freshly graduated engineering student in a February 2010 DUI accident is missing from the Palm Beach County Sheriff‘s evidence warehouse, Gossip Extra has learned.

It’s no longer available for Goodman’s attorneys to analyze, something that could throw the millionaire’s re-trial for DUI manslaughter into chaos!

Doug Duncan, Goodman’s new defense attorney, made the stunning revelation today in a motion filed with a court in West Palm Beach and exclusively obtained by Gossip Extra.

UPDATE — Prosecutors say car disappearance won’t hurt their new case!

“The defense is shocked and surprised to learn that both vehicle, previously described as critical evidence, and that the integrity of said evidence could only be maintained by being held in state custody, are no longer in evidence and no longer available for examination by the defense,” the motion reads.

The absence of the vehicles could become a big deal since, in Goodman’s first trial, he claimed the Bentley malfunctioned and surged forward at a stop sign before colliding with the Hyundai.

The jury that found Goodman guilty of DUI manslaughter last year didn’t seem to believe that theory brought forth by Miami defense attorney Roy Black.

In time, Goodman was sentenced to 16 years behind bar, but a new trial was ordered in May because of jury misconduct.

Emails between Duncan and Assistant State Attorney Sherri Collins included in today’s motion, meanwhile, show that the wrecks of both the Bentley and Hyundai were released after the guilty verdict was pronounced.

In the motion, Duncan asked for all of the State Attorney’s documentation showing who ordered the release of the cars, and why.
