Lawyer: Pat Riley, Miami Heat Are Above The Law!

flag-exclusiveThe Miami Heat and team president Pat Riley are ducking a process server who works for star guard Dwyane Wade‘s ex-wife, according to a court filing in Miami-Dade County.

Riley has been named as a witness in an upcoming trial in Wade’s native Chicago that’s designed to determine how the Wades’ marital assets will be split!

Since Riley is ultimately Wade’s boss, ex-wife Siohvaughn Funches wants to have Riley grilled about Wade’s contract with the Heat.

Thing is: For as long as Riley isn’t served the proper paperwork, he doesn’t have to testify!

So Funches’ attorney, Lisa Macci, asked Circuit Court Judge Antonio Marin to force Riley to testify.

“Florida law says that an employer needs to make an employee available for service,” Macci said. “I guess the Miami Heat and Pat Riley are above the law.”

Process server Chris Yeoman, owner of Gotcha Legal Services, called the Heat “unprofessional.” His servers have tried to hand Riley his subpoena at the American Airlines Arena — to no avail.

“When you serve one of the Miami Dolphins players, the head of security always makes sure you are allowed to do your job,” Yeoman said. “The Heat are a bunch of nasty people. It’s obvious they want nothing to do with this case.”

Yeoman said Heat lawyer Raquel Libman refused to allow his staffer to hand the subpoena to Riley and was “rude,” argumentative and sarcastic. She didn’t return calls but the team’s outside counsel, Alan Fein, said Yeoman’s recollection of the incident is not accurate.

“It’s a frivolous motion,” he said.

Said Yeoman: “We never give up. He’ll be served, even if we have to do it at the NBA Finals.”

While Wade is officially divorced, the matter of marital distribution has not been resolved. As Gossip Extra first reported last month, the ball player already gave Funches $1 million and gives her $35,000-a-month.

Chances are, however, that he could be ordered to pay much more at the end of the trial, which is set to start in three weeks.
